We take the protection of your personal data very seriously. This is why we only process your data on the basis of the statutory provisions (GDPR, Telecommunications Act (TKG) 2003). The data protection information below provides you with information about the most important aspects of data processing on our website.


Getting in touch with us

The data you provide when you contact us using the form on the website or by e-mail shall be stored by us for a period of six months for the purpose of processing your enquiry and for any follow-up queries. We will not pass on this data without your consent.


Cookies

Our website uses so-called cookies. This involves small text files which are stored on your end device by means of the browser. These do not do any harm.

Our cookies are used to make our website more user-friendly. However, certain cookies remain stored on your device until they are deleted. They allow us to recognise your browser when you next visit our website.

Web analysis

Our website uses functions provided by the Google Analytics web analysis service. The provider is Google Inc. headquartered at 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Cookies are used for this purpose, which make it possible to analyse how users interact with the website. The information that is generated as a result is transferred to the Google server in the USA and stored there. You can prevent this by adjusting your browser settings as such, that no cookies are stored.

We have entered into a corresponding contract with the provider to process order data.

We have a legitimate interest within the meaning of the GDPR in improving what we offer and our website. Since the privacy of our users is important to us, all data relating to users is pseudonymised.

Your IP address is recorded but immediately rendered pseudonymous (e.g. by deleting the last 8 bits). As a result, only a rough localisation is possible.

Data is processed based on the statutory provisions of § 96 Para. 3 TKG and Art. 6 Para. 1 lit a (consent) and/or f (legitimate interest) of the GDPR.

The user data is stored for a duration of 14 months.

Mouse-Tracking

We have a legitimate interest within the meaning of the GDPR in improving what we offer and our website. This is why we use Hotjar so that we can better understand the needs of our users and optimise the services on this website. Hotjar's technology helps us to gain a better understanding of our users' experiences (e.g. how much time users spend on which pages, which links they click on, which things they like and dislike, etc.) which in turn helps us to customise what we offer based on our users' feedback. Hotjar works with cookies (see above) and other technologies with the aim of collecting information about how our users behave and about their end devices (especially the IP address of the device (only captured and stored in anonymised form), screen size, device type (unique device identifiers), information about the browser used, location (country only), preferred language for displaying our website). Hotjar stores this information in a pseudonymised user profile. The information is neither used by Hotjar nor by ourselves to identify individual users or merged with other data about individual users. Data storage through our webshop

We store the following data for the purpose of fulfilling the contract: Salutation, first and last name, address, e-mail address and optionally entered user data (company name, address details, telephone number). The data that you provide is required to fulfil the contract or to implement pre-contractual measures. We cannot conclude the contract with you without such data. Data shall not be transferred to third parties, with the exception of transferring the credit card data to the processing bank/payment service provider in order to debit the purchase price, to the transport company/shipping company commissioned by us to deliver the goods and to our tax advisor in order to honour our tax obligations. Once the purchase process has been terminated, the data we have stored will be deleted.

When a contract is concluded, all data from the contractual relationship is stored until the retention
period under tax law expires (7 years).

The data: name, address, goods purchased and date of purchase are also stored until the product liability expires (10 years). The data is processed based on the legal provisions of § 96 Para. 3 TKG as well as Art. 6 Para. 1 lit a (consent) and/or lit b (necessary for fulfilment of the contract) of the GDPR.


Registration and user account

Users of our webshop can choose to create a user account. We shall provide users with the necessary information (mandatory fields and optional details) as part of the registration process. The data entered during registration is used for the purpose of making use of the services we offer. Users may be notified of information relevant to what we offer or to registration, such as changes to the scope of the offer or technical updates, by e-mail.

In the event that users terminate their user account, their data shall be deleted from this account; one exception to this rule is data, the retention of which is necessary for commercial or tax law purposes pursuant to Art. 6 para. 1 lit. c GDPR. It is the responsibility of the users to back up any data in case of termination prior to the end of the contract. We have the right to irrevocably delete all user data stored during the duration of the contract.

We store the IP address and the time of the respective action by the user both in line with our legitimate interests and on the basis of the interests of the user in protection against misuse and other unauthorised use if a user utilises our registration and login function in conjunction with their user account. The IP addresses are anonymised or deleted after no more than 7 days.

As a matter of principle, we do not disclose the data to third parties, with the exception of situations where we have to assert our claims or where we have to fulfil legal obligations in accordance with Art. 6 Para. 1 lit. c GDPR.


Newsletter

You have the opportunity to subscribe to our newsletter through our website. We may also collect and process additional details that users provide voluntarily so that we can provide you with targeted information.

We require your e-mail address as well as your declaration that you agree to receive the newsletter to be able to send you our newsletter. Once you have registered for the newsletter, we will then send you a confirmation e-mail containing a link to confirm your registration.

Your newsletter subscription can be cancelled at any time. Please send your cancellation request to the following e-mail address: office@thermotec.eu.

We will then immediately delete your data associated with sending you the newsletter.


Google-Re/Marketing-Services

We have a legitimate interest within the meaning of the GDPR in improving both what we offer and our website. This is why we use the marketing and remarketing services ("Google Marketing Services" for short) offered by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google").

Google is certified under the Privacy Shield framework and in doing so, offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google marketing services allow us to display adverts for and on our website in such a targeted manner that users are only shown adverts that potentially reflect their interests. This involves Google running a code and using so-called (re-)marketing tags, which are used to store a unique cookie in the browser of the user. See above for the use of cookies.

The information obtained can also be associated by Google with such information from other sources. Should the user subsequently access other websites, they can be presented with adverts tailored to their interests.

The IP address of the user is also captured by Google Analytics, but immediately rendered pseudonymous (e.g. by deleting the last 8 bits). This means that only a rough localisation is possible, hence the ads are not managed and displayed for a specific person, but rather for the holder of the cookie, irrespective of who this cookie holder is. This does not apply, of course, where a user has explicitly allowed Google to process the data without such pseudonymisation. The information that is gathered about users by Google marketing services is transmitted to Google and stored on their servers in the USA. The IP address of the user is not merged with the data of the user as part of other Google services.

One of the cookies we use is from the "Google AdWords" Google marketing service; we may display adverts from third parties based on the "AdSense" Google marketing service and its cookies. We also use the "Google Tag Manager" for integrating the analysis and marketing services offered by Google into our website and managing them in a centralised manner.


Online presence in social media

We maintain an online presence within social networks and platforms so that we are able to communicate with users, interested parties and customers who are actively involved there. The terms and conditions and data processing guidelines of the respective operators shall apply when accessing these networks and platforms.

We shall only process the data of users if they communicate with us on social networks and platforms, insofar as not otherwise stated in our data protection declaration.


Use of Facebook social plugins

We have a legitimate interest within the meaning of the GDPR in improving what we offer and analysing, optimising and operating our website cost-effectively. This is why we use social plugins ("plugins") from the social network facebook.com, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). The plugins can display content such as graphics, text contributions or videos or elements for interaction on the website.
